I live in Houston and worked with Mr. Cardany on an estate sale last year. His office was prompt in all matters and the charges were reasonable. I'd work with him again given the opportunity.

He came recommend by my real estate agent. I received a letter from him in August saying thank you for selecting me. If you have any questions please feel free to call me. I had a lot of questions and not once did he call me back. I tried for 6 weeks to get him to return a call. He says he left a message on my cell phone, well that??s fine but my disposable cell phone doesn??t have voice mail. The phone was for me to contact my spouse without paying long distance charges. I had a lot of questions that he as an "attorney" should have been available to answer. I'd never purchased a home before; I needed answers and legal advice, which was not provided. I don't know if it was because I am a female with my husband being 5,000 miles away he thought he could walk all over me. I don't know why but?.. All I know is that I no longer even wanted the property; I was in tears so many times over it. At no point did I sign anything saying that I agreed to pay him for his services. In fact that was what I was originally trying to call him, to find out what his fees were. I asked his secretary and she said, ??You??ll have to ask Mr. Cardany?. Which I was trying to do but he wouldn??t return calls.

Now that I am in the house and looked over the paperwork, I want to see all the invoices that he paid on my behalf and he refuses to give them to me. I've asked the Better Business Bureau for assistance and he still has not provided them to the BBB or me. He even told the BBB that I swore at his staff, slander; I spoke to his secretary a couple of times and his legal aid once and used the word bull s__t, as in I??m sick of the bull s__t, and his legal aid hung up on me.

I elected to have him sign the paperwork as I didn't want to nor could I get off work to go for the closing. My real estate agent told me that we could close the end of August so I scheduled time off for it. Well that didn??t happen either. His secretary mailed me the paperwork for me to sign and send back to him. It was delivered postage due after the closing date, I sent it back postage due and asked for the invoices then. She had to bring it out to the house for my signature. I'm still waiting for a copy of it to be returned to me.

I paid for an appraisal but don't even have a copy of it, he says he didn't pay for it. I didn't so who did? I didn't even request one but the paperwork says I did and it was paid for by me. I had to put all the funds necessary for the closing and his fee, in his account. The property description is based on a road from back in 1947 when the house was built with the names of this person on this side and one on the other being the identifying boundaries. Those people aren't their any more. What am I supposed to do to get a legal description?

It's been a nightmare and it's still going on with me trying to get the paperwork I need for taxes.

I received the paperwork that he signed, and he only signed one page. Is this a legal and binding contract? I tried to have the mortgage company add my spouses name to the paperwork, I faxed them the approval to add him and signed it. They told me that the attorney had to do an amendment to the contract and that the signature didn??t match the signed paperwork they had. I explained that no it wouldn??t match because I didn??t sign it, the attorney did. What makes them think that he??ll return a phone call now that he??s already been paid?
