We lived in an apartment of theirs with rusty water for 10 months and they did not make any efforts to right it. Apologies for the lengthy review, but accuracy is critical!

My battle with Whisler began the month we moved in. We began to notice the rusty water coming in through our bathroom taps. I made a series of calls to our Property "Manager," Marlena, who told me that all old pipes do this, and I should worry about it. After another month, it began to be more frequent, and within three months it was constant -- a brown murky water coming out of the shower head every time we used it for about 1 minute. After another two months, it was coming out of every tap in our house, and would not cease after a minute -- sometimes ever. During this time I made a number of calls to Whisler and was told over and over again that they were simply waiting on the property owner to handle the issue (FIRST CHURCH OF THE NAZARINE -- yes, a church!!!!!). It had now been six months since we moved in, and no one had even been out to look at the water. During this time, we were purchasing drinking water, driving across town to shower at a yoga studio we both practice at, going to friends' houses to use their facilities, and doing our laundry elsewhere, as our water was completely non-potable.

I went in to speak to Marlena again, as she had started avoiding my calls and not responding to my emails. She assured me that they were on it. It took two months, but a plumber finally came out. After that, NOTHING. I finally called and demanded to speak to the Office Manager, Christina. Christina heard me out, requested that I submit a written report of everything that had occurred to this point, and apologized profusely for Whisler's inability to resolve the issue thus far. I was incredibly grateful -- finally, I felt, something would get done!!

Unfortunately, it was to no avail. I had a meeting two months post the plumber finally coming out to the property, with Christina and the owner of Whisler, Robert Winger. They both expressed outrage and scandal at what had occurred, and swore to immediately help us find a new place to rent. They also promised that they would return the entirety of our deposit; Mr. Winger literally said "It is the least we can do." I had brought a hundred-plus page dispute brief binder with photos, legal research, correspondences, a timeline of events, and a request for monetary reimbursement, as we had expended several hundred dollars at this point, and were living in an apartment that was legally uninhabitable. This binder supposedly was passed along to the owner of the property. While Whisler was the entity with whom we executed our lease, they insisted that they had nothing to do with it, and could not help us beyond passing along the message.

In the following weeks, I made several attempts to have someone "help" us find an apartment and received no information, no call backs, and even one no show at an apartment viewing. Stellar work there, Whisler.

Finally, I found a new apartment and we decided to move out, split ways, and continue to deal with Whisler on a strictly as-needed basis. At this point, I had invested more than 40 man hours in this project and had not seen any restitution -- beyond a few shallow apologies and empty promises.

The final kick came with our "deposit return". Even though we were promised time and again that we would be given our full deposit back with no qualms (even though I expressed that I would pay for those things that we damaged, exclusively including a small spot of paint that needed to be redone and a patch of carpet replaced -- totaling approximately $100.00, and confirmed by Christina), we were charged $430.00, for a number of unnecessary items.

I immediately called Robert Winger personally and asked him why it was that he was unable to honor his previous promise of returning our entire deposit -- which, in his words was "the least we can do." After a few minutes of discussing my concerns, he got very angry with me and began screaming at me, stating that I "won't get a penny from [him]!" And quite readily hung up on me. I was astonished at the OWNER'S inability to communicate in a professional manner, let alone the refusal to uphold his promise.

Our lawsuit is currently pending for uninhabitable conditions. We're seeking back rent, but at this point IT'S NOT THE MONEY. Had these people simply put us in a new apartment as promised, looked at the pipes (and FIXED them) and returned our deposit, we would have happily concluded the matter. I NEVER intended for this to be a monetary issue; I literally wanted clean water and nothing else! Yet, by refusing to negotiate as a decent company would and instead making false promises and refusing to honor them, they've created a complete and unnecessary mess.

HORRID customer service. My neighbor has dealt with a rude guy, they've let service people in unannounced, and Robert Winger is completely unprofessional. He called me a year and a half ago - I had NEVER talked to him before or even heard of him. He didn't identify himself as being from Whisler, he only said his name, so I thought he was a telemarketer. I thought he asked me how my job was, so I said fine. Then he said, "Yeah, this is your landlord, you're not supposed to have a dog." So I guess he thought that I had a dog (because my bf at the time had a dog and would stay over a lot at my place and bring her along). I said that I didn't have a dog, and he insisted that I did. "Yes you do! You have a big dog! And you have a bf that lives there with you too!" Neither of these facts were true, and I denied them. I said, "I don't know who you are or why you're calling, but I'm hanging up now." Because, really, I didn't know if he was whom he claimed to to be - and calling a single woman up like that asking if she has a dog and bf that live with her makes YOU sound like a weird stalking creep that's casing her home to break in and attack her. It gets even better because I called Whisler the next day and said someone by that name called claiming to be from them, and they put me on the phone again with Robert. I said that someone had called me from his number yesterday claiming to be him, and he said, "Oh yes, I remember you - you were the rude one." I said, "EXCUSE ME? You called me up out of the blue and started asking all kinds of questions about my personal life!" Robert then started yelling at me, "Why don't you just move? Why don't you just move?" So I told him to talk to my family's attorney, because my parents co-signed on my lease AND used to be landlords themselves when they lived in CA. He kept babbling about how I should just move, blah blah, and then I hung up on him again. I also made a complaint about someone named Joey to the OWNER of the company - Mark Whisler - because he was extremely rude to me on the phone, and Mr. Whisler sent me an email saying "This is a Health and Safety issue and you must provide access. I'm sure Joey was frustrated as his goal is to solve this immediate Health and Safety problem." That's really funny because they sure didn't seem to care about fixing my neighbor's shower which got backed up with sewage and he couldn't shower for several days!!! I also did NOT deny access to my apartment, I let the plumbers in twice before to inspect for their estimates - I just didn't call this Joey guy back until the next day because I was busy. I'm a reporter and rely on people calling me back on time and I still would NEVER be disrespectful to a source about it - people have their lives and they're busy with other things. That is no excuse for being so rude and unprofessional.
