Although I'm only giving them 1 star, I acknowledge it's probably not realistic of me to expect a better performance, since you get what you pay for in life, and H&S doesn't charge a fee but rather takes 25% of the retro award upon approval for disability. I'm sure we would've gotten better service on my wife's disability case if we were paying clients of a firm, but like most households that have lost an income to disability (MS in the case of my wife), we didn't have a budget for that, so H&S was the best we could do.

The MO at H&S seems to be to put the bare minimum effort into each case--just enough to keep it going--and if an award is given, they still get their 25%. If an award is not given, they're still not put out too much since they expended so little effort. I have no doubt that it's a very profitable business model.

In the 2 years that my wife and I have been grappling with this process, we received exactly zero guidance from H&S. They filed the initial forms, which were straightforward and would provide no challenge to anyone with any experience with paperwork, and then we never heard from them. There were no conversations about the specifics of my wife's condition, no suggestions about things to highlight for my wife's doctors (even though the things entered into the medical record are the main part of the case), no recommendations on supplemental items to send to SS ... basically, no counsel whatsoever. Calling and trying to get attorney recommendations is pretty much like pulling teeth. They simply aren't interested in guiding you through the process.

My wife, like many people, was rejected initially, then rejected on appeal, then had a SS hearing. As near as I can tell, the hearing was the sole place where H&S were actually somewhat useful. Although I was not allowed to attend, my wife indicated that Attorney Shapiro did most of the talking and was a strong and informed advocate for her. (I note, however, that we got denied again anyway, so I'm not sure how enthusiastic I'd be in my praise of his performance. He also didn't exactly knock himself out to advise us by phone in advance of the hearing, and we didn't actually meet him until about 10 minutes before my wife was due to walk in there, so not a lot of coaching.)

After our denial at the hearing, we had the option of appealing or of starting the process over. H&S made this decision for us and filed the appeal (without asking us OR telling us they did it; I found out weeks later when I called them about status); undoubtedly they viewed the appeal as the quicker route to a potential payout for them. They are very practical in their aim to extract money from this process as efficiently as possible. Given the choice, we might have elected to start over, solicit some 2nd medical opinions on conditions, and just generally beef up the medical record over the couple of years that the process takes. As I said, though, we were not consulted, and now too much time has passed since my wife worked for us to start the process over at the same benefit level. This is especially charming when one considers that a couple of months after committing us to this appeal, H&S sent us a letter saying that they didn't think we had a good enough claim anymore and they were dropping us as clients.

To sum up my review: If you're applying for disability and you're not good with paperwork or don't have a lot of time to keep up with the requirements of your case, it might be worthwhile to employ the limited efforts of H&S just to sort of keep the engine running, but if you elect to do so, just realize going in that you aren't going to get a lot of support. This is not like when you retain an attorney and they provide engaged representation. This is a mill; they will process you, NOT represent you. If you can muster even minimal time to devote to your own claim, you'd probably be just as well-served to manage it yourself for all the level of engagement your case would receive at H&S.

Do not use!!! They are liars and do not do their job in their clients best interests. I used them and lost 27 months of benefits. If you call them, you're put on hold forever. It was over 2 years before I ever spoke with anybody but a client advisor. They had a year to submit evidence of 2 MRI's, 8 surgical procedures, physical therapy reports, cat scan, ER records, X-rays, mylogram and numerous Dr. reports. Only 1 request was sent and it was received the day the appeals council was to review my case. No new information was provided to Social Security. When I asked Heard & Smith why my records weren't made available to Social Security, I was told that Social Security wouldn't have taken them into consideration. Yet, when I spoke with Social Security, they told me that of course they would've considered them. Do not trust these people. On a scale of 1-10, they are a -10.

Didn't get past the initial screening call(s). This is a law firm?? It felt more like a penny stock boiler room. Sad what our profession has come to in some places, like this. I'm general counsel of an investment firm with a lot of big and small legal issues, so I deal with a very large number of law firms and lawyers across the spectrum, and this was the worst excuse for a legal intake process I have ever encountered. So I will take my family's issue elsewhere.

so far , they dont return calls , got denied WITH LAWYER ( att B.Shapiro) , I DONT know how I could possibly get denied .now waiting for retun calls that never come , lawyer Shapiro NEVER RETURNS MULTIPLE CALLS . you get no response from heard & smith , all I have gotten is the run around so far , If I end up with a differant outcome I'l retract this review, but I'm seeking help from a QUALIFIED ATT. NOW . TIRED OF THE HEARD & SMITH RUN-AROUND . find a differant att. who handles their business professionally , this group does NOT.

I am one of the lawyers mentioned in ??Rodeoqueen??s? review posted on 08/21/08. As with all things in life, there is another side to this story. Rodeoqueen and her sister were the opposing parties in this matter and lost the case. Naturally, they did not like us -- we were the opposing lawyers. We won the case for our client. As lawyers, we are used to seeing anger and resentment when we defeat the other side in court.

Rodeoqueen and her sister challenged every action our client, the executor, took in the estate ?? from the very first hearing to the very last ?? even the smallest issue was opposed. Had they not opposed every proceeding, expenses could have been drastically reduced. As we do with all of our clients, we represented our client in this case effectively and zealously. The Court ruled in our client's favor, she received the inheritance that she was entitled to receive and she has not stopped thanking us.

I don't understand how these other posters had bad experiences with Heard and Smith. They helped me win my benefits! I was referred from my cousin who also won his benefits with Mr. Heard. I tried to do the application on my own, but was sent a denial. I didn't know what the process was so I thought that was it. Turns out there was a deadline to appeal. That's when I knew I needed professional help and glad that I picked Heard and Smith. They took the time to educate me about the process, gave me resources to get medical treatment and food stamps, and took care of all the forms that I needed to fill out. I'm glad they filled out those forms because I have Carpal Tunnel and it is hard to hold a pen for over 5 minutes. To sum it all up, I got my benefits after 5 months because they submitted a dire need letter for me to expedite my award. I now have my own place and able to live on my own. Thanks Heard and Smith. I'm forever grateful

You have been warned. Stay the hell away from Mark Smith and Clayton Mankser. These two charged my mothers estate over $17,000 and did nothing. They got two of my mothers properties condemned because they did not meet with the city. They charged the estate for services they did not perform. They created anomosity between my sister and I so they could steal from us. They will bill you for every phone call down to the penny. They dragged my probate case out for almost a year and a half now and it is still going on. My mothers probate was a simple case and could have been handled in a few months. Every attorney I called to represent me said to talk to my sister to get them off of the case because they are snakes.

I am warning you now......STAY AWAY. It is attorneys like them that give attorneys a bad name. They will have you and your siblings fighting each other while they laugh all the way to the bank.
