In August 2005, we moved from Florida to New York because my wife was
accepted to New York University College of Dentistry (NYUCD). We
rented apartment N23K at the Rivergate (R) located at 401 East 34th
Street, New York, NY 10016. The lease was signed on August 8, 2005 and
we paid up-front for a year of rent. We discovered a sub-street level
heliport across the street from Rivergate and behind FDR Bridge and
highway. No heliport signs were posted anywhere in the vicinity of R.
Donna Ferri (DF), the real estate broker at R, photocopied my wife??s
acceptance letter but did not disclose the presence of the heliport
orally or in writing. The staff showed us the apartment on the weekend
when the heliport was closed. The heliport cannot be seen from
apartment N23K, and DF withheld a document from the lease disclosing
the presence of the heliport, a critical factor in our decision to
rent at R. Upon recent investigation, DF leases apartments for
seventeen years without a real estate license and works for the Donald
Zucker Company, a national mortgage and equity brokerage firm. Donald
Zucker, a real estate agent and landlord of R has a criminal record.

The apartment was subject to constant aviation pollution from the
nearby heliport. In 2005 the heliport operated between 8:00 am and
10:00 pm M through F averaging 79 flights per day. The interior
apartment noise levels exceeded 60 db and escalated as high as 90 db.
To survive in an inhabitable apartment rental, my wife was forced to
designate the restroom as a study. Despite R receiving five
violations, they consistently refused to comply with the housing laws.
For personal safety and health reasons, we moved to a hotel in NJ for
3 months and on August 17, 2006 permanently moved out of NYC.

My wife lost her profession and education at NYCD. Both of us have
been significantly delayed in attaining our careers, professions, and
having a family for a long period of time.

In November 2009, my wife was accepted to the University of the
Pacific Dental Hygiene Program entering class of 2010 but had to defer
her acceptance for 2011 since we were unable to make up the cost
difference between the financial aid award and the tuition.

Cons: NOISE & FUMES from Helicopters, Unlicensed Broker, Criminal

I lived at the Rivergate (34th Street & 1st Ave) and actually lived through the worst nightmare. The helicopter's noise and deadly fumes were unbearable.

My husband and I were treated like animals; I resorted to studying on the bathroom's floor for 8 months, trying to do my best as a first year dental student at New York University College of Dentistry.

I placed a comforter and sofa pillows on the floor, laptop on a toilet seat, and with my back against the bathtub, I studied for my classes. The noise was so excessive that I felt the vibration of bathroom walls and apartment fixtures.

The landlord Donald Zucker was informed about the terrible living and studying conditions via Martha Rosa (the tenant liason) and did not do anything!!! They let us suffer! What kind of human beings are they? My husband informed Thomas Eschmann, the manager of Manhattan Skyline Management, and we received letters declining any repairs or replacements of damaged window frames. After 8 months, the apt received 5 violations by the city inspector sent out by the Investigating Governor.

When Rivergate received violations, we were more harassed by management than ever before. We called the police, and the police waited in the lobby. For some reason, they could not "find" our apt. [ Is it because Zucker paid for their annual ball? It must be so. ] Likewise, the city inspector only arrived because he was sent by the investigating governor. We have the video of regular inspectors seeing the broken areas of the apt and NOT writing down the violations. It took regular inspectors 8 months to check the apt. They were paid off, too.!!!!

Our door lock was broken and doors could not lock. We packed what we could (mostly my study materials) and moved to the hotel in New Jersey. What a relief that was! We finally could sleep, rest, and I could study! No helicopters, no toxic fumes.

By the way, the Rivergate Apts do NOT have the carbon monoxide detectors which is a violation of the law, too. There is so much more to this and I will be posting every day because up to this point, I was holding everything inside. It is killing me. We lost everything we worked for because of landlord's greed. How come the landlord is not punished to the same extent as my husband and I were punished? I want the landlord to live in the same apt and watch his wife suffer the same way we have suffered. I seek justice, and I will get it!
