My history with Dana Thurman and his business is short and simple. About six months ago, I went to his shop to service my vehicle. I felt the service I received was not performed and refused to pay. I then requested police to come so a report could be made. The police refused to show up and said the shop owner would need to take me to small claims court to pursue this civil matter.

That evening I wrote a negative but honest review of what I encountered at Alert Muffler & Brakes Services located at 1505 S Solano Dr, Las Cruces, NM 88001, onto google maps. I have updated it a few times to give readers a more accurate account of my experience, all while staying within limits of Googles typed character restrictions. Currently there is no legal matter on file with the courts that I am aware of and I have not been served any court documents on this matter.

U.S. Marshal Simon Delgado first appearance at my apartment was on Thursday, March 10, 2016. I was not home then, so my roommate entertained him at the door. He identified himself to be a U.S. Marshal while displaying his badge. He was looking for me to discuss business between myself and Alert Muffler. He asked questions in attempts to get him to divulge more information about myself. He carried a printed copy of the google review I had written months ago and allowed my roommate to read it. When I returned home that evening I was notified about this event and was told this U.S. Marshal intended to revisit me in the future.

At approximately 2:45 PM on Wednesday, March 16, 2016 would be the second time U.S. Marshal Simon Delgado appeared at my apartment. The doorbell rang and neither I nor my roommate were expecting anyone. I set my iPhone to record. I answered the front door to find nobody there. Within seconds this person walked around the apartment to our patio and appeared knocking on the glass door. It was as if he were trying to catch me hiding from him. The patio door had slightly opened blinds. Since he was so close to the glass, he now had complete view of the living room and kitchen. This proved to be huge intrusion of our privacy. This total stranger was now calling on me as if he were my friend, saying Im sorry Robert, I walked around.

When I opened my patio door he said My name is Simon. Im a Deputy Pro Marshal. Im a Deputy U.S. Marshal. Im going to end up serving some papers on you I talked to your roommate Do you know what its about About the letter that you wrote about Alert Muffler not a letter a complaint about the service you received on your mustang. This and more are captured in the audio recording between myself and self identified U.S. Marshal Simon Delgado later adding Retired to his title.

During the conversation U.S. Marshal Simon Delgado admits to that no documents have been filed by Alert Muffler or by the shop owner Dana Thurman. He mentions he has done some research on me and found legal matters that may be pending. He later invited me to view recorded video at Alert Muffler to see that what I was alleging was all false. To have a man show up at my door identifying himself to be a federal officer representing a privately owned business and its owner is illegal. Especially when he admits to not visiting me on official capacity, telling me to pay the business and remove my online review. I have posted the audio on YouTube to show what type of business Alert Muffler is. I have filed a formal complaints with U.S. Marshals Office and this matter is currently being investigated.

If you have been approached by Simon Delgado identifying himself as a U.S. Marshal, report it to U.S. Marshals Office at the Federal Courthouse. They would like to hear about it.
