Nixon obtains settlement with Florida collectibles franchise operating in Branson; consumers to receive $15,417 restitution

Forsyth, Mo. - A Florida business that accepted payment from consumers for clocks at some of its Missouri locations but failed to provide the merchandise or refund the money will pay $15,417 in restitution and stop violating state consumer protection laws under an agreement with Attorney General Jay Nixon. Judge Mark Orr entered the Consent Injunction and Final Judgment that has been worked out between Nixon and American Clocks Inc. of Plant City, Fla., which uses the name Father Time Clocks and Collectibles to do business, today in Taney County Circuit Court.

Nixon filed a lawsuit against Father Time Clocks and Collectibles on July 16, after complaints alleged that the business accepted money from consumers for clocks that were never delivered. Nixon said that, in total, thousands of dollars worth of clocks had not been delivered to consumers who had already paid for the merchandise, and that the business also failed to issue refunds to consumers.

As part of today's agreement, Father Time Clocks and Collectibles is permanently prohibited from continuing to violate state consumer protection laws in the sales of its merchandise, including accepting payment for items and not providing the merchandise or refund. The business is also required to pay $15,417 in consumer restitution, and would face a civil penalty of up to $5,000 per violation for any future violation of any term or condition of the agreement.

My mother purchased a rhythm clock from Father Time in Myrtle Beach in December 2007. They had a part-time set up at Coastal Grand Mall, however, operate out of a store at Broadway at the Beach. She paid cash and never received her clock. I got involved being a resident in Myrtle Beach and got a run-around for months. Turned it over to the Better Business Bureau who, after failed attempts to receive a response, stated there was nothing they could do and the S.C. Atty. Generals office indicated the same. William Futch personally told me that they used the money received from orders to pay bills because they have no money to actually purchase the clocks. Unbelievable they are still in business and have a store in a prime location. What a joke. Stay away!!!

I wish I had read these reviews before my husband and I forked over nearly $700 - in cash - for a Rhythm clock in the Myrtle Beach store -- the store located at Broadway at the Beach, 1203 Celebrity Circle, N-15 Myrtle Beach, S.C. 29577. That was almost four months ago. I've been calling both the store in SC and Mr. Futch in FL. When his voice mailbox isn't full and I get to leave a message, he never returns my calls. Sometimes I do get to speak to a very nice lady at the store, but there's nothing she can do! Isn't there anything that can be done?

I purchased a Rhythm clock and a Howard Miller clock from this company on 11/20/07. After continues days of calling I did receive my Howard Miller but as of this date I have not received my Rhythm clock. We have called and contacted him several times and were told that he was getting a personal loan to pay his vendor for the clock. As of three weeks ago he will no longer answer his phone or return any calls. Do not even attempt to do business with this man!

My two sister's and I purchased four, five hundred dollar clocks september 26, 2007. We cannot get anyone to return our calls. We contacted the Mo Better Business Bureau of Springfield, With no luck. The Bureau has closed the case, due to no response from the business.
We the people, can stop businesses like this. We can pass the word to all that will listen. Your daughter, sister or mother might be their next customers to cheat. I really take offence to the salesman's parting remark. Thank you ladies and may God Bless you. Can you believe a remark like that,when he knew what was going to happen? Please don't be his next victim.

I ordered a pillow from this company 4-22-08 and was promised that it would be shipped the next Monday. After many calls to Branson and the billing or main center in Florida and their assurance that the pillow has already been shipped, I have not received this order. Today's date is 5-21.08. Don't do business with this company

I must confer with the previous reviews. Fortunately, I only lost $30 to these people which I was on the verge of loosing a couple of thousand. Not only did I cancel my order with them after reading the previous reviews along with checking them out on the MO. BBB (which they had 25 complaints for Father Time in the past 36 months), I found the same grandfather clock $600 cheaper closer to home.

They have yet to return my $30 and it's been 3 weeks since I called them. It's very difficult to get through with the multiple of phone numbers that they provide. I'm really glad we didn't have our check book handy to give them the $500 they wanted.

Thank you to the 5 previous folks who wrote their reviews warning everyone of this company.

This guy ,William Futch who sent me a $50.00 gift certificate two months after he took my $350.00 deposit on a clock will not respond to giving me my money back. I have called Branson Landing to notify them of his operation, and also Rhythm clocks of this behavior. He charged me under another business name: American Therapy Products...buyer beware. Know that you only have 120 days to get ar efund from your credit card. He also has a company in Florida under same name.

We to ordered 3 clocks from Father Time Clocks & Collectibles and never got them. Found out they have gone bankrupt. Luckly my credit card gave me my money back.

We too purchased not one, but three clocks on 11-5-07. We were promised delivery in 8 weeks, however, we are now approaching 13 weeks and cannot reach anyone who can help us research our order. We paid for these three clocks in full on a Visa. Everytime we try to call the store at the IMAX location in Branson or the billing center in Florida, we only get an answering machine stating that the messages cannot be received and/or message box is full. The one time someone picked up the phone, we were promised a call back and never received it.

I guess our next step is to get our CC Company involved.

1/26/08 I purchased and was asked to pay in full for a clock on 9/21/07 which i have never received. I am turning it over to my visa card to fight this fraud operation and the District Attorney of Mo. I have asked for a full return of my money on my visa and this has not happened yet. jane

I purchased a clock at this store on 04/22/07 and have yet to receive it. They have an unsatisfacory rating on the Better Business Bureau website because of non-delivery of their products.This company also operates under the name, American Therapy Products, PO Box 2633, Plant City, FL 33564-2633.
