Company refuses to pay employee for 26 hours worked and documented. Foreman who hired employeed denies benefits. Had employee complete application, w2 form in whch case the employee claimed three exemptions, and had completed time sheets with the time keeper for the company by intialing time sheet. Former employee went to company today to receive his first paycheck and was denied. He was told by the owner of this subcontracted company that he was just a waste of time and money and does not need to be paid. Employee had to be out on medical leave soon after he started by his physician and orthdontist and the foreman had spoke with employee's wife and stated that he could return to work when he was able. Sounds very fishy to me and work ethics and responsiblities need to be investigated. He was in training with a current driver so there would be verification of hours worked. Also sounds like identity theft as well. A FOIL request should be made of the personnell files and also their accounting files. Vehicles need to be inspected and checked for current registrations. The company's business practices need to looked into and reported to the Department of Labor, Attorney General, District Attorney, Internal Revenue Service, and Department of State.
