Re: Mr. Charles T Scott Jr., Case# F1B9-D5B%

Dear Mr. Moskowitz:

I have researched this matter and found the following: Mr.s Scott purchased a used 2006 Mercury Mariner from us on April 22, 2010. The purchase price of $17,600 included a 3 month 3,000 mile limited warranty from us. He was offered the opportunity to purchase an Extended Service Contract but declined.

In August, Mr. Scott contacted us to report that his vehicles?? engine had been diagnosed in Vermont, as having a failed connecting rod bearing. Our Sales Manger contacted our Director of Fixed Operations, Bill Lauer, who made several attempts at contacting ??Dusty? before actually speaking with him. Dusty informed Bill that the oil level was fine, the oil appeared dirty and that a rod bearing had failed due to lack of lubrication. When asked the condition of the main bearings, Dusty said that they were fine. Bill asked for specifics regarding the wear on the main bearings because in the case of lack of lubrication, the main bearings would normally fail before rod bearings. Dusty informed Bill that they had not disassembled the engine, not even dropped the oil pan, and had made the diagnosis absent direct visual inspection. This brings the whole report into question. We do not even know if the engine is ??unfixable?; the oil pan has not been dropped to make an inspection of the bearings. Excessive carbon build-up on a piston or no spark to a cylinder can also present as a ??rod knock?.

Mr. Scott contends that the 3 month, 3,000 mile warranty is a policy ??designed to protect the seller?. To the contrary, it is designed to protect the buyer, while putting a reasonable limit on the liability of the seller. Automobiles are by their very nature, complex mechanical devices. Not all potential problems can be foreseen at the time of purchase. It is for this reason that new vehicle manufactures put limited warranties on their new products. It is for the same reason that we put a limited warranty on this used vehicle, it basically helps to assure that the vehicle is ??whole? at the time of purchase. This vehicle had over 62,000 miles at the time Mr. Scott bought it from us, and we had it for about 5 of those miles. At some point, it becomes Mr. Scott??s responsibility not ours and that point was after 3,000 miles in his possession.

We inspected this vehicle prior to sale and did not notice an engine problem. Mr. Scott test drove this vehicle prior to purchase and did not notice an engine problem. Mr. Scott drove this vehicle for over three months and for over 3,000 miles and did not notice an engine problem. There are conflicting reports regarding the oil level in the vehicle at 3,500 miles. One report from Vermont, indicates oil level ??three quarts low?, pretty significant in a vehicle with a five quart oil capacity. Another indicates the oil level was fine. Mr. Scott never mentions seeing an oil warning light, so it seems likely that the oil level was never ??dangerously low? if it was low at all.

It is unfortunate that Mr. Scott is having trouble with his vehicle. It is unfortunate that he chose not to purchase an extended service contract. It is unfortunate that this is all happening in Vermont, not here. None of this makes us responsible for the damages outside of the warranty period.

Sincerely,

Paul Frank

I recently purchased a new car from Faulkner-Ciocca from Souderton. I saw the car on the Internet and called and spoke to the Sales Manager. I was given a good price and the car was exactly how it was described to me (no surprises). I was very pleased with the dealership and the way that they handled our transaction and how they treated me and my family. Very low pressure approach, and they went out of their way to accomadate us. I would definately reccomend doin business wth Mr. Cook and his team at Faulkner-Ciocca.

Faulkner gave me a good price on my used truck but I didn't think I would be sacrificing quality for a fair deal. They told me that everything was great with the vehicle and that their technician checked it out thoroughly. Well, two weeks after I purchased my truck, I took it in to my local garage for a safety inspection. My garage told me that by PA state inspection procedures, the truck should not have passed inspection (which had just been performed within 1 month of my purchase). The emergency brake levers were seized and the shoes essentially fell apart upon removal. I live 2 hours away from Faulkner and had to get the brakes repaired at my home shop. When I asked Faulkner if they would at least help me out with the bill for repairs, they told me I was "upsold" and that my brakes didn't really need fixed and that my home garage was just looking for something to fix. It sounds to me that Faulkner knows a thing or two about "upselling" consumers. Buyer beware...especially if Faulkner is out of town for you. They DID NOT stand behind the vehicle that they sold to me. All I got was a lot of talk, days and days of waiting for e-mail and phone call returns. I am on my own to make any repairs necessary to a vehicle that was "inspected thoroughly" by their technician.

As opposed to the mega store in Quakertown, this Faulkner Ford is a pleasure to deal with. The sales guys are the no-pressure type, and the boss is a great guy. Thye even let me borrow a convertible for the day to see if I liked it on long rides and around town! Nice! Service people are great, too, and the shuttle service is a plus. Selection could be bigger, but that's because they just don't have the room. They'll find the car you want and deliver it pronto.
