Don't be confused by the one person who may have not received the exact results he wanted in his case. No attorney bats 1000, especially when the defendant is trying to interfere with the attorney. I met Mr. Breston and agreed to hire him for a criminal background case. I called the office and paid with a credit card. Then I changed my mine in not hiring him and called to get my refund back and went to another lawyer. He returned all my calls immediately to receive my refund and now that we had the other lawyer I wished I had hire Mr. Breston!
David Breston is an extremely terrible criminal defense attorney. When you inquire about hiring him, he will say what you want to hear and fill you with false promise and hope. Pretty much as soon as you sign the papers and are represented by him, he drops the act. I won't get into specifics but here are just a few of the things which make him an absolutely awful lawyer: -Before you pay him, if you ask questions about your case and how he would go about defending you, he will not be forthcoming and will insist that you hire him first. He even gave me the line: "I can't legally help you if you haven't hired me as your attorney yet." This is BS, any lawyer worth his salt would be more than willing to give you a free consultation regarding your case. And as if to reaffirm this fact, he didn't even give us basic information such as what his approach to my case would be, or what possible consequences I am facing. Can you guess why? Because the check hadn't cleared yet.
And no, I don't expect any attorney to defend me without yet being paid, but I DO expect them to give me a possible idea as to what they can do for me, legally.
Another reason he should not be hired by anyone facing criminal charges is that he will likely hurt your case rather than help it, because he is very inexperienced in criminal court proceedings. I'm not sure why this is, since he advertises himself as a "criminal defense" attorney on his multiple websites.
He will also speak to the prosecutor about details you do not want him to divulge, and will attempt to lessen his workload by working WITH the prosecutor in trying to push you into the very first plea deal they offer you, so that he does not have to work on your case anymore. Keep in mind, he is doing all of this behind your back. When you specifically ask him to tell the prosecutor or judge something that you know will help your case, he will tell you he mentioned it, but he won't actually bring it up with them. He will become belligerent if you question him, and he even went into a tirade right outside the court room, in the Harris County courts' hallway. Complete with offensive language and name-calling. And it just so happened that the prosecutor in the case was less than spitting distance away from him during all this. Yup.
And last but not least, his childish manner and inability to remain composed for even half an hour. If you disagree with something he says or suggests, he will stare at you as if he you've just insulted his intelligence, and will then stop listening to your questions and instead interrupt you while you are talking and berate you for disagreeing with him, something to the tune of:
"Ok, well what if I decide to---"
"No, I know how the system works and what to do, not you".
"But what if I--"
"You hired me to handle this case, so keep your concerns to yourself and let me work on it".
And if still you are insistent in letting him know what you think, he will pull out his phone and start fiddling with it, until you've repeated yourself numerous times, and then he just goes on with what he was saying without once acknowledging your questions and concerns.
He also pulls out his phone quite often even when not arguing with you. He sits there and texts right in the middle of a conversation (I'm assuming he texts, I don't know for sure but he stares at his phone and presses buttons, so I'm assuming he's texting). Once he is finished doing that for a few MINUTES he will look back up to you and ask "so what were you saying again?"
I know this sounds like a complete smear-review of him, but it is the truth. If you do not believe me, then hire him for yourself. I have nothing to gain nor lose by writing this review and am posting it to warn others who may consider using him.

I am in the United States in an H1B visa. I was charged with assaulting my wife, Mr. Breston was able to convince the prosecutor to dismiss my case after I finished domestic violence counseling. I am now able to renew my visa and will not be DEPORTED.
